Allgemeine Geschäftsbedingungen
These Terms of Service govern the use of the squibble/email service operated by Squibble GmbH. By accessing or using the service you agree to these terms.
Effective: May 2026 · Governing law: Switzerland
01 Scope
These Terms of Service ("Terms") apply to all use of the squibble/email service ("Service"), this website, and any associated APIs, SDKs, or tooling provided by Squibble GmbH ("Squibble", "we", "us").
The Service is intended for commercial use by developers and businesses ("Customer"). By joining the waitlist, creating an account, or otherwise accessing the Service, you confirm you have the authority to bind the organisation you represent to these Terms.
02 Service Description
squibble/email is a secure email gateway API that enables software agents and applications to send transactional and notification emails and to read inboxes — without exposing underlying SMTP credentials. The Service provides:
- JWT-scoped tokens with per-mailbox, per-verb access control.
- Outbound email dispatch via authenticated SMTP over STARTTLS.
- IMAP inbox read access scoped to the bound mailbox.
- Bounce classification, suppression management, and idempotent send.
- Open and click engagement tracking.
03 Access & Accounts
Access to the Service is currently invitation-only via the waitlist. Squibble reserves the right to accept, defer, or decline any waitlist application without stating a reason.
You are responsible for maintaining the confidentiality of your account credentials and JWT tokens. You must notify us immediately at hello@squibble.ch if you suspect unauthorised access to your account or tokens.
Accounts may not be shared or transferred. Each organisation must maintain its own account.
04 Acceptable Use
You may use the Service only for lawful purposes. You must not use the Service to:
- Send unsolicited bulk email (spam), phishing messages, or malware.
- Send to recipients who have not given valid consent under applicable law.
- Circumvent or attempt to circumvent suppression lists, bounce handling, or rate limits.
- Conduct security testing against the Service infrastructure without prior written authorisation from Squibble.
- Use the Service in a way that violates any applicable law or regulation, including CAN-SPAM, CASL, or EU ePrivacy Directive.
- Resell or sublicense access to the Service without prior written agreement.
Squibble may suspend or terminate accounts that violate this policy without notice. Persistent or deliberate violations will be reported to relevant authorities.
05 Customer Obligations
- You represent that you own or are authorised to use every email domain and mailbox you connect to the Service.
- You are responsible for configuring valid SPF, DKIM, and DMARC DNS records for your sending domains.
- You are responsible for obtaining and retaining proof of consent for every recipient you send to via the Service.
- You must maintain an accessible and functioning unsubscribe mechanism for marketing emails.
- You agree to respond to suppression and data requests forwarded to you by Squibble within 10 business days.
06 Pricing & Payment
The Service is currently in early access and is provided free of charge to accepted waitlist participants. Squibble reserves the right to introduce paid plans with at least 30 days' advance notice delivered to the registered account email address.
When paid plans are introduced:
- All prices are in Swiss Francs (CHF) and are exclusive of VAT unless stated otherwise.
- Invoices are due within 30 days of issue.
- Overdue accounts may be suspended after 14 days' written notice.
- Squibble may adjust pricing with 30 days' written notice. Continued use after the notice period constitutes acceptance.
07 Availability
Squibble targets 99.5% monthly uptime for the API and email dispatch path. Scheduled maintenance, force majeure events, and third-party SMTP provider outages are excluded from uptime calculations.
Squibble provides no uptime guarantee during the early-access beta period. Formal SLAs will be published alongside paid plans.
08 Data Processing
Squibble processes personal data (email addresses of your recipients) as a data processor on your behalf. You remain the data controller for that data. Full details of how we handle this data are set out in our Datenschutzerklärung.
For customers subject to the GDPR or Swiss revFADP, Squibble will sign a Data Processing Agreement (DPA) on request. Contact hello@squibble.ch with the subject line DPA Request.
All data is stored in Switzerland. See the Security page for full jurisdiction and compliance details.
09 Intellectual Property
The Service, including all software, documentation, branding, and API design, is the exclusive intellectual property of Squibble GmbH and is protected by Swiss and international copyright law.
These Terms grant you a non-exclusive, non-transferable, revocable licence to use the Service for the purposes described herein. No licence to any Squibble intellectual property beyond what is necessary to use the Service is granted.
10 Liability
To the maximum extent permitted by Swiss law:
- The Service is provided "as is" without warranty of any kind, express or implied, including fitness for a particular purpose.
- Squibble's total liability for any claim arising under these Terms is limited to the fees paid by the Customer in the three months preceding the claim.
- Squibble is not liable for indirect, incidental, or consequential damages including loss of business, loss of revenue, or loss of data.
- Squibble is not liable for email delivery failures caused by recipient-side spam filters, third-party SMTP providers, or DNS misconfiguration on the Customer's domain.
Nothing in these Terms limits liability for wilful misconduct or gross negligence under Swiss law.
11 Governing Law & Jurisdiction
These Terms are governed exclusively by Swiss law, excluding conflict-of-law provisions and the UN Convention on Contracts for the International Sale of Goods.
The exclusive place of jurisdiction for any dispute arising from or in connection with these Terms is Zürich, Switzerland. Squibble reserves the right to take action in any other jurisdiction to enforce payment obligations or protect intellectual property.
12 Amendments
Squibble may amend these Terms at any time. Material changes will be communicated to registered users by email at least 30 days before they take effect. Continued use of the Service after the notice period constitutes acceptance of the updated Terms.
